Terms of Service

Welcome to Thaively ("Thaively," "we," "us," or "our"), a web-based platform for learning Thai script, tones, and vocabulary through spaced repetition. These Terms of Service ("Terms") govern your access to and use of thaively.com and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use Thaively. If you are under 18, you must have a parent or guardian's permission to use the Service. By using Thaively, you represent that you meet these requirements.

2. Accounts

  • You must provide accurate information when creating an account and keep your login credentials secure.
  • You are responsible for all activity that occurs under your account.
  • You must notify us promptly at contact@thaively.com if you suspect unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscriptions and Billing

  • Thaively offers a free tier (Levels 1-3) and a paid subscription tier (Level 4 and above).
  • Paid subscriptions are billed on a recurring basis (monthly or annual, as selected at signup) through Stripe, our third-party payment processor. We do not store your full payment card details; Stripe handles all payment processing.
  • Automatic renewal: Subscriptions renew automatically at the then-current price at the end of each billing period unless canceled before the renewal date.
  • You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; you will retain paid-tier access until that period ends.
  • Refunds: New subscriptions include a 7-day money-back guarantee. If you are unsatisfied within 7 days of your first payment (whether monthly or annual), contact contact@thaively.com for a full refund. After this 7-day window, payments are non-refundable, including for partial billing periods if you cancel mid-cycle. Canceling stops future billing but does not refund the current period. Nothing in this section limits any non-waivable statutory refund or withdrawal rights you may have under the laws of your jurisdiction.
  • We reserve the right to change subscription pricing with reasonable advance notice. Continued use of the paid tier after a price change constitutes acceptance of the new price.

4. Description of Service

Thaively provides gamified, spaced-repetition-based tools for learning to read Thai script, recognize tones, and build vocabulary. Content includes mnemonics, example sentences, and audio pronunciations generated via text-to-speech technology. We do not guarantee any specific learning outcome, fluency level, or pace of progress. We may add, modify, or remove features of the Service from time to time; if a change materially reduces the paid tier's core functionality, you may cancel your subscription as described in Section 3.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems.
  • Scrape, copy, or redistribute Thaively's content (vocabulary lists, mnemonics, audio, or software) without permission.
  • Share your account credentials or paid-tier access with others.
  • Interfere with or disrupt the Service's infrastructure or security.
  • Use automated tools (bots, scripts) to interact with the Service outside of normal use.

We reserve the right to suspend or terminate access for violations of this section.

6. Intellectual Property

  • All content on Thaively, including but not limited to the vocabulary database, mnemonics, example sentences, audio files, software, design, and branding, is owned by Thaively or its licensors and is protected by copyright and other intellectual property laws.
  • You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial learning purposes.
  • You may not reproduce, distribute, modify, or create derivative works from Thaively's content without prior written permission.

7. User Content

The Service allows you to submit or save certain content, such as personal notes or memory aids attached to vocabulary items, feedback, and support messages ("User Content").

  • You retain ownership of your User Content. You grant Thaively a non-exclusive, royalty-free, worldwide license to host, store, display, and process your User Content as needed to operate, improve, and support the Service (for example, storing your notes and showing them back to you).
  • You represent that you have the right to submit any content you provide and that it does not violate any law or third-party rights.
  • We may remove User Content that violates these Terms or applicable law.

8. Third-Party Services

Thaively relies on third-party providers to operate, including:

  • Stripe for payment processing
  • Supabase for account authentication, database, and storage
  • Microsoft Azure for text-to-speech audio generation
  • Vercel for hosting
  • PostHog for product analytics

Your use of the Service is also subject to the applicable terms and privacy policies of these providers where relevant. Our Privacy Policy describes how these providers handle your information.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THAIVELY AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

11. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Thaively and its operators from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your User Content, or your misuse of the Service.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or where reasonably necessary to protect the Service, with or without notice. You may stop using the Service and delete your account at any time. Provisions of these Terms that by their nature should survive termination (including Sections 6, 9, 10, 11, and 14) will survive.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice (such as posting an update on the Service or emailing registered users). Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law principles. If you are a consumer in a jurisdiction whose laws grant you non-waivable rights or require the application of local law, nothing in these Terms limits those rights.

15. Miscellaneous

  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
  • Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Thaively regarding the Service.
  • No waiver: Our failure to enforce any provision is not a waiver of our right to do so later.
  • Assignment: You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
